MCN BABE OF THE YEAR 2009 - Vote Terms and Conditions

This voting system has been set up for you to vote for your favourite MCN Girl to be crowned ‘MCN Babe of the Year 2009’.  The promoter of the MCN Babe of the Year 2009 is Bauer Automotive Limited (Company No. 696758) with registered office address of 21 Holborn Viaduct London EC1A 3DY ("Bauer") Photographs of our 6 finalists can be found on http://www.motorcyclenews.com/mcnbabes The girls will be appearing at the London Motorcycle Show January 29th-February 1st, where they will be wearing T-shirts with their name printed. To vote for your favourite girl please first read these terms and conditions carefully and follow the procedure specified below.

The girl who receives the most votes will be crowned MCN Babe of 2009 at the London Motorcycle Show at 4pm on Sunday 1st February.

You may vote either:
• via the premium rate SMS number specified, just text the name of your favourite girl to 80889. Girls names are as follows:

• via http://www.motorcyclenews.com/mcnbabes (the Website) without charge.  Please note there is a limit of one vote per person for this free option.

• There may be high volumes of people voting, if you have difficulties getting your vote through either by SMS or the Website then please wait and try again within the voting times specified below.
• Voting commences on 10am Thursday 29th January 2009 and closes 12pm on 1st February 2009.
• Bauer may in its sole discretion change the rules for voting at any time
• Cost of voting via SMS is 50p per text plus standard rate message charge of the voter's network operator. The total cost will be dependent on the voter’s network operator.
• There is no age restriction to vote.
• SMS voting is available to the UK only.
• There will be no refunds for texting an incorrect number.
• Votes made outside the voting dates and times specified above will not be counted but may still be charged.
• Please ensure that you have the permission from the bill payer before voting.
• Bauer cannot accept any responsibility for any SMS entry charges.
• Voters may make multiple votes, however Bauer reserves the right to disqualify votes if they have reasonable grounds to suspect that fraudulent voting has occurred.
• Voters will receive confirmation for their vote,
• Bauer Media and CTA staff directly connected in any way with the competition are not eligible to vote.
• Bauer do not accept any responsibility for any votes that may be lost or delayed through technical failure or problems with any telephone network, service provider, system server, Website or software or otherwise which may result in any vote not being registered or recorded.
• Bauer cannot promise that the SMS phone lines or Website will be free from errors or be available uninterrupted and in a fully operating condition. Bauer will not be liable to you or to any other 3rd party in the event that all or any part of the SMS phone lines or Website is discontinued, modified or changed in any way.
• Nothing in these terms and conditions shall exclude or limit Bauer's liability for death or personal injury caused by it's staff or negligence or for fraud.
• Subject to the above, Bauer does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by any voter howsoever arising from participating in voting whether due to any error, omission or other cause by Bauer, its employees, agents or others to the fullest extent permitted by law.
• The highest number of votes will determine the winner of MCN Babe of the Year.
• In the event of a tie a Director of CTA will decide the winner.
• If there is any fault, mistake, misunderstanding or dispute concerning voting or the operation of any part of the voting process, network or phone system or Website, the decision of Bauer shall be final and no correspondence will be entered into.
• Any votes which are misspelt and incomprehensible or which are not in accordance with these terms and conditions, or not received by Bauer will be void.
• If any of the 6 finalists are unable to or are prevented from attending the London Motorcycle Show due to medical reasons or for other reasons beyond the control of Bauer then an authorised representative of Bauer will decide whether the finalist concerned will continue in the competition. A standby contestant may be allowed to take a finalist place at the discretion of the authorised representative of Bauer.
• Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.
• The winner of MCN Babe of the Year 2009 will be announced at the London Motorcycle Show at MCN Live at 4pm on the 1st February 2009.
• The winner will be crown MCN Babe of the Year 2009 and will win a 1 years modelling contract with CTA, photo shoot with Motor Cycle News and a bag full of beauty goodies.
• These terms and conditions shall be exclusively governed by and construed in accordance with the laws of England and the voter irrevocably submits to the exclusive jurisdiction of the courts of England and Wales.

(a) Your Name
(b) The telephone number of the phone you text from
(c) The date(s) and time(s) you text when you experienced problems where relevant
(d) The nature of your query or complaint
(e) If possible, your telephone network operator, e.g. BT, Virgin, Cable & Wireless
(f) A contact telephone number you can be reached on, if necessary.
