How i did it
OK this was for a car, but i got Gatso'd twice n got off twice using the same defence.
1) get another person on the insurance for your vehicle well befor any offence.
2) When you get the NIP ask for their evidence.
3) When it arrives throw it in the bin (they never send it recorded)
4) On the summons send a letter pleading not guilty
5) On the date of the hearing take along a copy of your insurance, bank statement, credit card statements, home and mobile phone bills for the date of the alleged offence.
6) Your case is that you cannot remember who was driving at the time of the offence, as you and the other person on your insurance equally shared the driving. You have tried to find out who was driving at the time by examining all the documents (Statements etc)to see if they gave you any clues (a phone call on your mobile bill at the time the GATSO went off would show you were not driving as, of course, that would be illegal. N STUPID). As none of them helped, you asked for the safety camera partnerships evidence but that never arrived! REMEMBER to keep and take a copy of your letter asking for the evidence with you to court. So you have shown due diligence in trying to find out who was driving.You will have to hand over all your statements and letter for the magistrates to consider, so check them first to make sure they do not contradict your statement.
6) As you have shown due diligence in trying to inform the authorities as to who was driving you cannot be prosecuted for not disclosing the drivers details and as only an individual driver can be convicted of the offence of excess speed the case should be dropped.
As i said i have got off twice using this defence, which in my case was of course totally honest. One offence was in the mad mullah's own local court!

Just for the record i do not condone speeding but the authorities insistance that all accidents can be prevented if we all drove around at 10mph is stupid. GATSO's do not catch drunk or dangerous drivers.
