Possible white line fine

Possible white line fine

Was riding with a buddy today on the A23 towards Brighton, and we was in the twisties and it was a double white line section and as I could see the oncoming road for miles and the car in front was slow I overtook on the white lines with my friend behind the car I overtook. He told me that I was riding for some time after and noticed that the car was a unmarked police vehicle with one copper inside, the copper opened the drivers window and took a picture of me riding perfectly legal - can I get a fine for that ? As the picture only shows me riding legal and Normal ?

PLEASE ADVISE!!

Pic?

Basically it wasn't  a nessacary overtake but I didn't want to lose my power I had gained so overtook the car so crossing the white lines - there's no doubt of the offense but whaT I'm worried about is the picture he took when I was riding as normal, I wasn't speeding but what could he possibly do with the picture as it doesn't show the offence ! That's my concern

His word against yours

and he'll win it if it goes to court, as for taking a photo of you while driving ? did he have a hand held camera poking out the window ? if he did there's your way back at him cos that has to be illegal.

Can you request to see the proof before you accept the NIP ?

Nope, NIP is just that, a Notice of Intended Prosecution. You wont be able to view any evidence until AFTER you have accepted the NIP and then they attempt to prosecute/charge you.....

If

He opened the window to operate his camera, then he, himself would be guilty of careless driving.  He was not in full control of the vehicle, just as using a mobile phone.

Actually 'yes'.. and you must.

Me and few mates did this once before, seen by off duty copper overtaking over solid whites, ask for photo evidence so you can identify the rider... you were out with a mate yes??? I expect you may have swapped bikes at some point that day yes??? Tell them you were not sure who was riding at the time, ask for the photo.. if they provide it take it like a man... If, as was the case with mine they can't... then they CANNOT prosecute you and willl have no choice other than to drop the charges!

Good luck... and yes, as long as you didn't actually cross that line you did nothing wrong!

The Feds

Are you sure it was an unmarked police car? Do they normally travel two up? They would have camera equipment on board. Perhaps it was a native having a bit of fun. I think you need to receive your NIP within 7 days so you'll know soon enough

Unmarked

I've been pulled by an unmarked car with only one copper in it. He didnt prosecute, so not sure if he could've done anything.

Yamark..

In  my experience if they can do you.. they will do you..

If they 'choose' to be nice to you take it waith a pinch of salt... it usually means they've f*cked up and did not turn the right equipment on or summink..   :doubt:
