Dear Sir or Madam
I acknowledge receipt of your letter regarding the alleged speeding offence in Bury.
I can remember the speed camera taking the photos of me in the Citroen van and noted i was only doing a few mph and though nothing would come of it..I have included the two pictures of my van and have noticed it has not moved very far from one picture to the next in fact it has moved two road markings which are 3 feet apart (i have measured them )I understand there is a 0.5 second gap between the photos ,from this i have worked out the following
Formula speed=gap x marks x 0.6818
3 x2 x0 x.6818=4.09 mph
As you can see just over 4 mph is nowhere near the speed limit (30mph)
Also you can see in the photos barely two van lengths in front of me the traffic is stationary as there is now gaps between the cars i am unlikely to be doing 43mph with such a short distance to stop.I think you need to re-examine my case

i think they would like to keep that a secret or as lot of people would like there money back or a lot of cases would have to be re-looked at

Hmm

Nice one!

I wonder how many people have paid the fine and not looked into it? Quite worrying.

i would have paid it but i saw the flash and looked at the speedo and laughed but then thought how to prove my innocence as the vehicle in front and behind had left a large gap and the still pic did not portary the 4mph i was doing

good for you...  i.m.o.  tho, even without the other cars in the pics.. you couldve proved you werent speeding simply by the number of markers you covered in the time between the two pics...

also, for reference, if you go to court the prosecuting force HAVE to allow you access to ALL the evidence no less than 7 days prior to your case being heard, or it can be thrown out of court as you are not aware of the evidence against you, which makes it a biased case, as you are not aware of the full facts and cannot prepare a full defence without ALL the evidence...

hence why, me personally. if i were to go to court for speeding, i wouldnt chase the force for the photos.... give em enough rope 'n all that!!

Just for reference.....

E.C.H.R Article 6 the right to a fair trial:

Procedural standards are one important way in which fairness is protected. In civil cases, for example, parties are required as a general principle to disclose documents that they will rely on in court, as well as documents in their possession, even if these are detrimental to their case. They should also exchange the statements of the witnesses they wish to call in advance.

10 These requirements ensure that both parties know the facts of the case and can respond effectively to allegations against them. In criminal cases the prosecution has a duty to declare all its material but there is not an equivalent obligation for the defendant.
