A colleague of a friend Friday just gone, took it upon himself in their lunch break to do a bit of blatting on a very busy road. Not giving any details but as an insurer how would you see it.

 

No helmet full throttle about 150 yard straight with vans and all sorts constantly nipping in and out of entrances. Long wagon reverses out, only slowly but sees said bike but too late. 

Bike swerves and rights off a car and also himself plus bike.

He will be ok hopefully in time and plenty of witnesses.

How would an insurance company proceed. 

One private car written off, and I suppose commercial vehicle did reverse out but stopped as soon as he saw the bike coming.

Private car was parked legally on the road, but bike riding like a loon with no helmet and plenty of witnesses to state this was the case.

Hopefully the guy is ok but a difficult one to unravel

If it can be shown that the biker speeding was a contributory factor then it might go 50/50. A long vehicle should never be reversing out without a banksman. Not wearing a helmet will affect the injury claim but not who was at fault.

The lorry's insurance company will assess how far the bike was from the (now) stationery lorry.  They will decide the rider was at fault and won't accept any blame.

The car driver will have to sue the bike rider, and everyone will have to pay even more next year.:blink:

A) Witnesses said he was caning it... but in a short space could possibly have only been in 2nd gear and it may have sounded like he was going quicker than he was

B) No helmet....only he suffered that decision,

C) Long vehicle reversing out of an obstructed entrance without a banksman.... he did stop well before impact and biker did not make contact with the vehicle

D) Yes private car will claim off his insurance ???

I knew a chap who didn't have a licence but still got compensated for a disability after his accident when the driver admitted he was at fault.

 

I will follow it with interest.

Irony is that if he had been wearing a helmet the chances are he wouldn't be here now:shock:
