Swerve test violates health & safety

I am about to take my part 1 Motorcycle test and have been doing some reading about the hazard aviodance at 50km/h.

Firstly as a ‘born again biker’ may I say during training I found it difficult and in six attempts did not achieve 50km (47 best).

However reading a letter about the DSA accepting no liability for anyone injuring themselves left me perplexed to say the least. Section 3(1) of the health and safety at work act states that every employer must conduct his undertaking in such a way as to ensure that people not in his employ are not exposed to risks to their health and safety. Thier statement would not hold up in court of law, and if an accident occures through thier negligence then they will be liable.
