FAQ: How to handle a Failing to stop charge

Some people say that when you get done for speeding you are really being punished for driving without due care because you failed to see the camera.

But what happens if it was a manned speed trap and you didn’t see the policeman trying to pull you over?

In that case the offence is “failing to stop”. It is not endorsable, but does carry a fine up to a maximum of £5000.

If you were going more than 20mph over the limit you could be disqualifed, though hopefully it will be a short ban. A best-case analysis would be three to five points and a fine.

If you are ever in Court on this charge, stress that you were concentrating on the traffic around you, and not stationary pedestrians.
