Speed camera loophole discovered

A Welsh motorist had his speeding charges dismissed due to a legal loophole which could lead to many more cases being dropped.

Phillip Dennis, 34, of Whitford, North Wales, had his case dropped due to a discovery by Flintshire magistrates’ clerk Paul Conlon. Mr Conlon realised that Mr Dennis had not signed a form declaring the identity of the offender.

The form is sent by police to those accused of speeding after being ‘caught’ by speed cameras. It asks who the rider was at the time. It is an offence not to name that person. However, to be used in court, the form has to be signed. At the moment, there is no legal requirement to sign it.
