Legal advice: what to do if the work car park is dangerous

Riding to work is a great way to beat the traffic, especially if you have got a works car park to leave your bike in safely. But what do you do if the car park is in a shocking state with potholes and sharp objects that mean you have picked up numerous punctures?

The law says that employers have a duty to make sure that every floor surface is in a proper state for its purpose. There shouldn’t be any hole or slope or anything uneven or slippery which could put someone at risk.

That includes car parks, and the same thing would apply to a private car park, incidentally. Your employer has a duty of care to ensure that any visitor, including an employee, is reasonably safe to use the premises.

It depends on the extent of the debris, but you could well be able to recover your losses from your employer. If you do decide to go down that route, you need to take pictures of the scene and keep any sharp objects that have caused problems to help your legal claim.
