The small print

These terms and conditions should be read together with and are in addition to MCN’s standard Terms & Conditions at (together the “Rules”). This Competition is promoted by MCN, Bauer Consumer Media Limited  whose registered office is at Media House, Peterborough Business Park, Lynch Wood, Peterborough, PE2 6EA  and registered under company number. [1394141 /  01176085] (“MCN”).

1. What is the Competition about?
By commenting on the Facebook post MCN creates for the Competition, by uploading a video on Instagram, or by tweeting on Twitter using the hashtag #MCNBUCKLEUP. Participants must show how fast they can put on and fasten a crash helmet (double D ring buckle only). Each day of the Competition Period, the Participant that completes the task in the fastest time will win a £20 voucher to spend at,2113,710. The winner of the fastest time overall will win a new Shoei NXR crash helmet up to a value of £399.99. No cash alternatives are offered. Participants need to fulfill the below elements to participate in the Competition:

a) Comment on the competition announcement post dedicated for the competition on Facebook with a video, post the video on Instagram using #MCNBUCKLEUP, or tweet the video on Twitter using #MCNBUCKLEUP;
b) By doing so, Participants agree to the Terms and Conditions as stated in this document.
The entire Competition begins Friday Oct 28, 2016 9.00am BST and ends on Monday November 7, 2016 9.00am BST (the “Competition Period”).  

Participating in the Competition is free and open to everyone who is aged 18 years or older as of the date of entry and is a legal resident of and domiciled in the UK (excluding Northern Ireland). Employees and immediate family members of employees of any business that is involved or associated with the Competition (including Bauer Media and its associated companies) are not eligible to enter the Competition. Bauer Media reserves the right to verify the eligibility of all Participants. 

3. How to Participate
NO PURCHASE NECESSARY TO ENTER OR WIN. There is no fee charged to enter the Competition other than the cost of accessing the internet. One entry per person. Participants can make their entry by commenting under the Facebook competition post, by sharing their video on Instagram using #MCNBUCKLEUP, or by tweeting the video on Twitter using #MCNBUCKLEUP. The video must show the participant using a crash helmet that is currently legal on UK roads.. Video showing helmets that are not UK road legal or have a chain strap fastener other than a Double D ring style buckle do not qualify for the Competition. Participants may not include information on the application forms that is partly or as a whole unlawful, offensive, inappropriate or contrary to good morals or denigrating to Bauer Media publications (including MCN) or the Competition. Bauer Media will have the sole discretion to reject or remove comments submitted by the Participants that do not comply with this paragraph or the spirit of the Competition.

4. Prize Selection
One winner will be selected each day for a total of ten (10) daily winners. Winners will be announced at the end of each day by a post on Facebook, Twitter and Instagram. The overall winner will be announced at the end of the ten days. Time starts when the participant first touches their crash helmet. Time stops at the moment the participant lets go of the fastened strap. Participant must show that the strap goes through both D rings before returning through the first D ring. MCN’s selection will be binding and final. All decisions are final without recourse to legal process.

5. Prizes
Each daily winner will receive one (1) voucher to spend in the MCNShop with an retail value of £20.  The winner will be contacted via Facebook, Instagram or Twitter message and must respond within 48 hours of the message being sent. If the winner does not respond within 48 hours, the prize will be distributed to another eligible Participant. The overall winner will receive a 2016 model Shoei NXR crash helmet in any size and colour up to a retail value of £399.99. The overall winner will be contacted via Facebook, Instagram or Twitter message and must respond within 48 hours of the message being sent. If the winner does not respond within 48 hours, the prize will be distributed to another eligible Participant.

Bauer Media reserves the right to substitute a prize of comparable value for the original prize in the event of prize unavailability. Prizes are not redeemable for cash. It is the winners’ responsibility to ensure that they are capable of accepting the prizes. All decisions are final without recourse to legal process. Winners accept that by entering any of the elements of the Competition they may be asked to take part in related publicity and promotional activities. Winners may have their name and country displayed on the Facebook Site and/or on any other Bauer Media websites.

6. Prize Value
By accepting a prize, each winner agrees to be responsible for all state, provincial, local, or other applicable taxes associated with acceptance and use of the prize. All prizes awarded are personal and non-transferable and cannot be redeemed for cash or credit. Bauer Media reserves the sole right and discretion to change any of the prices by another prize of higher or similar value.  Where required by law, prize winner will be required to complete applicable tax forms such as a W-9 and provide a tax payer’s identification number.

7. Intellectual Property Rights
By submitting text and, if applicable, images (“Content”): The Participant warrants to Bauer Media that:
i). the Participant is the sole owner of all intellectual property rights relating to the Content, in particular the copyright and any other intellectual property right relating to submitted texts.
ii). The Participant thus warrants having the full right and title to submit the Content, and that the Content is free of any rights or claims of third parties that could be asserted against the use of the Content.

7.2  The Participant agrees to indemnify and hold Bauer Media and its affiliated companies, its officers, directors, employees and agents harmless from any and all:
i). Losses, costs (including reasonable attorney fees) and expenses awarded against Bauer Media; and/or;
ii). rights or claims alleged against Bauer Media, arising out of or resulting from a breach of the Participant's obligations under this clause and/or in respect of claims that anything done or provided by the Participant infringes the intellectual property rights owned or asserted by third parties.
7.3 The Participant grants Bauer Media and its affiliated companies a worldwide, royalty-free, non-exclusive, unrestricted, transferable, sub-licensable right to use the Content in connection with the Competition and related business purposes, including for promotional activities as further described in these Terms and Conditions. This right includes, but is not limited to the permission to:
i). copy, distribute, publicly display, make publicly available and modify the Content. This includes inter alia all graphic media (like catalogues, brochures and flyers) and online media such as (internet, intranet and mobile networks) regardless of the used techniques;
ii). change, format, divide, split or combine with other logo’s and brands, also related to for instance contests or promotions from Bauer Media;
iii). distribute and make publicly available, notably to promote MCN, in particular the Competition. This includes the right to use the Content for commercial purposes, in advertorials, inter alia in store and on internet, and for internal and external and promotional communication.
7.4 The Participant warrants that the entry does not infringe on the image and personality rights of persons that are recognizable in the Content.
7.5 To the extent permitted by law, the Participant unconditionally and irrevocably waives, and shall procure that any third party engaged by the Participant in the production of the Content shall unconditionally and irrevocably waive, all moral rights relating to the Content. This includes in particular, but is not limited to, the right to claim authorship and the right to object to adaptations, modifications and other changes to the Content. The Participant hereby declares that the Participant will not use any moral right to oppose, prevent or impede the acts of using the Content described under these Terms and Conditions.

8.  Privacy Statement
For this Competition Bauer Media needs to use the information about the Participants and others, which Participants enter on the Facebook Site. As a Participant, you need to be aware that some of the information you submit, such as photos and comments, could contain (sensitive) information about you and others. You need to make sure that you only submit information about others, when you have permission from them to do so. Bauer

Media will use the information for the Competition and promotion of the Competition. Bauer Media will destroy all information submitted within three (3) months after the Competition ends, except for the information from the winner. Bauer Media will continue
to use your name and email address for its own general promotional purposes, but only if you give permission for this on the Facebook Site.

Bauer Media adheres to European Union and other local privacy laws. Based on this, Bauer Media will only use your information for the purpose and duration for which it was obtained. Bauer Media will protect your information against misuse. Bauer Media will not give anyone else access to your information, unless explicitly and lawfully ordered to do so, following due process.

9. Notice and Take Down
All material (including, but not limited to, Content) posted on the Facebook Site must comply with these Terms and Conditions. Bauer Media reserves the right at all times to take down any material Bauer Media considers to be unacceptable, illegal or in any other way violating the Terms and Conditions. If you consider any material related to the Competition to be illegal or unacceptable and wish to complain, please send an e-mail outlining the nature of your complaint. On receipt of your notice, Bauer Media will investigate the complaint and may, as a result, remove or edit the material at issue.

10. Prize Conditions and Releases
By entering and participating in the Competition, each Participant agrees on behalf of itself and each of Participant’s heirs, executors, and administrators (i) to release and hold harmless Bauer Media and their respective officers, directors, and employees (collectively, “Released Parties”) from any and all liability, rights claims and causes of action that entrant may have or which may arise against the Released Parties for any illness, injury, death, loss, litigation, or personal or property damage that may occur, directly or indirectly, whether caused by negligence or not, from such Participant’s participation in the Competition and/or his/her acceptance, possession, use, or misuse of the prizes or any portion thereof; (ii) that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prizes, including, without limitation, to such prize’s quality or fitness for a particular purpose; and (iii) to be bound by these Terms and Conditions and to waive any right to claim any ambiguity or error therein or in the Competition itself, and to be bound by all decisions of Bauer Media, which are binding and final. Failure to comply with these conditions may result in disqualification from the Competition at Bauer Media’s sole discretion.   

10.           Liability
Nothing in this Competition or these Terms and Conditions shall operate so as to exclude or limit the liability of Bauer Media which cannot be excluded or limited by law. Although Bauer Media will use its best effort to arrange for a smooth operation of the Competition, Bauer Media shall not be liable for any damages – except in the case of willful conduct or gross negligence on the part of Bauer Media or Bauer Media management – that arise from the Competition in general or the use of the Facebook Site specifically. Participating in the Competition implies knowledge and acceptance of the characteristics and limitations of internet, inter alia technical performance, the transfer of information and data, the risk and effect of interruptions and more in general the risks that are inherent to communication through internet, such as limited data protection, malware and viruses. It is the responsibility of the Participant to take all foreseeable and reasonable measures to protect his computer and its content. Use of Facebook, Twitter, and Instagram sites and participating in the Competition is at the sole responsibility of the Participant.

Bauer Media shall carry out this Competition in compliance with the laws and regulations on promotional games of chance and skill and promotional gifts. Participants are responsible for ensuring that they comply with the Facebook, Instagram, and/or Twitter terms and conditions and any other Third Party terms and conditions that may also apply.

Permitted Assignments and Delegations
Bauer Media may, without notice and without the consent of Participants, assign any of its rights relating to its operation of the Competition or delegate any of its duties relating to its fulfilment of the Competition under these Terms and Conditions, if such assignment or delegation is to an affiliate of Bauer Media.
